My husband is in receipt of ESA support group and claims for me. We are both in receipt of PIP enhanced on both, my husband is also in receipt of his state pension. We are classed as mixed age couple. I am in receipt of a private pension of £142.30 per month. When I contacted citizens advice I was told that I did not have to declare my pension as it was less than what they could deduct. Today my husband received a letter from ESA saying that our money has been reduced due to my Occupational pension/Annuity. Following this new assessment they have reduced our money by £32.80 per week. Citizens advice explained how to make the calculations and ESA calculations doesn't add up. I thought if anyone would be able to help me it would be you guys. Thank you. Kim.

Hi Kim

To answer your question we need to know what type of ESA are you in receipt of (contribution based or Income based). You need to seek advice from a Welfare Rights Organisation who can take all your circumstances into consideration. You can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies.

Whether it will affect your ESA will depend on the type of ESA you receive.

You state that you are in receipt of a private pension and later in your post mention a occupational pension, if you are in receipt of both then you have to add them together.

If you are only receiving Contribution Based ESA then a lump sum will not affect your ESA but a regular payment will. If the pension is more then £85/week then there will be a £1/week deduction for every £2 in excess of the £85.

Your private pension works out at £32.84 pw, so if you are in receipt of CB ESA then you are not affected however, if you receive an occupational pension on top then you have to add it to your private pension if more than £85 pw then you will be affected.

If you are receiving any Income Related ESA, either in part or in whole, then the pension(s) will affect your ESA.
