SAR – still waiting was created by hugh mann
Hi there,
In March, requested my docs from DWP under SAR using your template. They only supplied the ESA85A. Despite 2 letters & 2 follow up calls, told will take sometime for the other docs. Still waiting, it’s now well beyond the 40 days deadline! Reluctant to contact them yet again so any advice of my options would be most welcome. Is there a B&W more robust follow up template letter?
In a previous SAR 5 years ago, they had destroyed my docs after 14 months (although had a continuous live claim), so could not obtain them!

PS: The website’s new format looks brilliant – WELL DONE to all!

Hi, hugh mann, how infuriating! Not sure but can you now report them to the Information Commissioner?

Thank you for the compliments, I have to agree with you the new format does look good, I cannot take any credit, it is all down to the back office.

In regards to your SARs request, this is the official ICO website ico.org.uk/your-data-matters/your-right-...copies-of-your-data/ if you click on next at the bottom of each page it will take you to how to make a complaint to the ICO, I think you have to click about 3 times. You do have to make a complaint initially to the DWP before the ICO will take up your case.

In regards to your question: How long does an organisation have to respond?

An organisation normally has to respond to your request within one month.

If you have made a number of requests or your request is complex, they may need extra time to consider your request and they can take up to an extra two months to respond.

If they are going to do this, they should let you know within one month that they need more time and why.

Hi hugh mann,

Like yourself, I requested a SAR from the DWP in writing in 2017, sent by recorded delivery.

I waited the mandatory time, still no response.

I chased it up by telephone call, still no response.

I wrote and complained, still no response.

In every document, review, new claim I mentioned I had requested a SAR and still no response.

My point is, even though the DWP ignored me, at tribunal they were asked about these numerous requests which were absolutely ignored, and they could not give a plausible explanation to the tribunal.

I believe this went in my favour, as ( only my opinion) it proves that they ignore claimants and any information they send or request are ignored.

Keep asking! And ask again, document everything, every telephone call, who you spoke to, call duration, if posting keep every receipt.
