i am preparing mr for my wife in the section in pip for toilet needs what is needed to qualify for help with incontinence they have accepted that my wife is incontinent with epileptic fits and that i have to wash and change her after a fit but again fail to give any points for this. i would be grateful for any advice on what they accept as needing help with incontinence.

Hi Subby

I don't know whether you have had a close look at our guide to PIP claims and reviews, but there is some advice on how you should answer these questions. I don't know how often your wife has an epileptic fit. In order to qualify for any points - she would have to be affected (ie incontinent because of her epilepsy) for 50% of the days in a 12 month period and you would need to explain this.

thanks for reply she is on 2-10 major fits per day most times incontinant

Hi subby,
I'm sorry to hear that your wife has several fits per day. With that many fits, she should certainly qualify for points insider Toilet needs. You may also wish to consider whether your wife needs supervision whilst doing other activities to ensure she is safe - eg preparing food, washing, managing therapy, (monitoring?)
Planning/following journeys. Maybe also for taking nutrition?

did have points for these but no points for incontinence and at this review they have removed the 2 points last given for eating and drinking also she can only walk short distances they have dropped the points saying she can now walk 50 m also even though she is drugged up to the eyeballs they will not give points for complex budgeting decisions i do all paperwork and finance but they keep saying she could do it if she wanted to. so i have a long mr to write now probably followed by appeal

I am not sure from your post if you have asked DWP for a copy of the assessors report (PA4)

Once you have a copy of the assessors report, go through it line by line.

I usually use a highlighter to highlight any inaccuracies, once you have gone through the report you then set out why you are applying for a MR and go through each descriptor one at a time why you disagree with the assessor and try and match it with any supporting documents you may have sent in.

Understand that the assessor is offering an opinion when they say 'in my opinion' you can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said., remember they are just an opinion which is not based on fact.

Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

Lastly, make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors. As in BIS previous post check out our guide to help you with your MR.
