Not exactly a PIP question but - I have recently won a Upper Tier Tribunal and the case has now been taken up by the Independent Case Examiner. I shall certainly get a positive report from them as the Tribunal ruling was damning. What I want to know is if anyone knows if I can sue the DWP for compensation?
(I do have my PIP review next March)

How much compo do you think the DWP paid for a thirty two page very critical judgement??
£350!!
A four year fight, complete victory and I am worth 350 bloody quid.
I laughed (but took the money as it is apropos nothing at all)
So I need to take it further.

I really wouldn’t hold your breath. Being in the right and having supporting evidence is just ignored by ICE / DWP even when you are a major pain in the A. I got ICE to agree to ask the DWP to do a (historical) revision decision, due to DWPs own evidence on their own systems (which I obtained from a SARS request) and the DWP just point blank refused… though it took another year and several more attempts to actually get this refusal letter (which mysteriously vanished in the postal system). 2-3 year drama and still no resolution….. Fight all the way but expect nothing… And then fight some more x

The Commons work and pensions committee has put an anonymous survey online that they want claimants to complete, telling them about your experiences of PIP assessments and the WCA and how the system could be improved.
The survey allows you to vent your frustration, I believe it is open until February 2022
