DWP response to Appeal was created by Moira
I was cut off my pip on June 2019 after a mandatory reconsideration and appeal. I had half of the inside of my left knee removed in 2016 and I had a nervous breakdown also in 2016. It was said that my knee had now recovered from the surgery when infact I am on the waiting list for a knee replacement since the surgery. I was also and still am under a psychiatrist and the mental health team and I am on lots of medication for my nerves. I was so exhausted from the appeal and my nerves could not take any more and my advisor from the CAB said that they could not see any legal points from my evidence in my pip appeal that they could use to take my pip claim supercession. I didn't even know what supercession was and I left it at that because I was told that I had no evidence to use. Is this correct as I have no clue and I am still learning about pip, thanks

Hi Moira

I have moved your post. We ask people not to ask their own questions in someone ele's post as it can become confusing when we're trying to answer them.

I'm sorry that you've had such a difficult time with PIP. I can't actually answer your question and say whether the CAB was right or wrong, because we are not party to the details of your case and are unable to say whether there were any points in law that you could have challenged at the time. If this decision was made in 2019 - it is too late to do anything about it because to challenge it, you would have needed to have done it within a year. I can understand that you felt too exhausted to deal with it.

I don't know whether you have, or whether you can face it. You could apply for PIP again and you could use our excellent guides to help you through the process.
