Changes in PIP law and FTT decisions letter

Hi I am due for review soon.

Today I recived a letter with the heading above, and saying
"our records show you have had a previous appeal decision. we do not look at PIP decisions where a decision was made by an appeal tribunal. we do not have the legal power to change these decisons . we can check any other decisions we have made since your appeal to see if you are affected by the changes in the law,
we can also look at your award if the amount of you need is changed...
if you would like us to look again at your pip award please contact us ...
if you ask us to look again at your pip award we will have to review it in full....not just because of the change in the law ....we will let you know if this is the case
our decision may change...go up, go down, stay same or stop...
you will be able to appeal
if you do not have an award you may need to make a new claim...
if you think you may be affected...you can talk to ...etc etc...
Tad confused is this a review letter ?
my PIP history as follows :
1. Claim 1 12/03/2014
2. F2f 10/01/2015
3. Decision Date: 04/02/2015. Daily Living- 0pts. Moving- 0pts Planning- 0pts MR decision: Unchanged
4. Appeal FTT 10/07/2015. Appeal Allowed. Daily Living- 0pts Moving- 8pts Planning 0pts.
5. Standard Rate Mobility awarded.
6. PIP2 ( IU) Intervention 11 March 2016
7. F2f 06/07/2016
8. Decision Date: 18 July 2016 Daily Living 9pts Moving 4pts Planning 4pts.
9. Standard Rate Daily Living Awarded
10. Standard Rate Mobility Awarded.
11. PIP AR1 10 July 2018 Completed.
12. F2f 22/01/2019
13. Decision Date: 1 February 2019 Daily Living 6pts Moving 4pts Planning 0pts.
14. Daily Living Standard Rate ended.
15. Mobility Standard Rate ended.
16. Request for Mandatory Reconsideration 22/02/2019
17. MR decision remained the same. No award.
18 . Appealed decision.
19 . DWP awarded PIP standard living 11 pts Mobility 8pts Planning 4 points
awarded from 1 February 2019 to 26 June 22 .

so im assuming I request a review ? There has been no change , when i appealed I was advised i was entitled to enhanced lived by CAB , which I am, but it was one of those calls , hello this is our "offer" ..... 4pts mobility 4 pts planning
i refused .. I am enetitled to 8pts mobility
.he called back next day , reinstated my 8pts for mobility and 4pts for planning , and 11 pts living, which I took as by then I was done in with them.
My conditions has worsened and there is no cure and therefore I am still entitled to PIP .
So its a review ?

Hi raindaisy

Without looking at the letter I cannot tell you if it was a review, I somehow doubt it unless you asked for a review.

It may be a LEAP letter that DWP are sending out to some claimants but I am only guessing, you need to take it to your Citizen Advice or Welfare Rights Organisation for them to check it out for you.

Hi raindaisy. Your current award ends on 26th June 2022. I personally would use Feb and March to gather together all your evidence together and do a draft application. I would phone up for a ‘review form’ AFTER 26th March (3 months before it is due to end). You will be sent a ‘new’ PIP claim form. It will be treated like a New claim as your last Award was a Tribunal win.

*I did this last year and didn’t phone up til 28 days before it was due to run out.

Your PIP award will not be extended whilst they ‘review’, so you may lose money for a while (but this will be backdated once you are successful. Ditto any SDP payments). If you put in a claim now, they will treat it as a ‘change of circumstances’, so your Tribunal Award can be changed if they decide you have ‘less need’. This ‘Change of Circumstances’ date will begin as soon as you phone up for the form.
