Problem with PIP was created by Kaya
Hi, I was checking Forum , but I could not find similar problem, hope anyone could help me.
My sickness started January 2021, as no one knew how long it could last. I flew to Poland for private treatment as NHS did not help me at all. My GP just gave me sickness fit to work form ( for every 2 months, last time for 4). I came back in September (I was less then 26 weeks abroad due to treatment). I had several doc appointment and spent a month in hospital. When I realized that my sickness is a long term I applied for PIP in November. I mentioned that I was abroad due to no help from NHS. I had no information from them until now. I called in December (I had just psychiatrist appointment and I thought that I can ask him for some letter to PIP). They told me that I will be contact with company and they will send me a letter because of time spend abroad ( should be before Christmas). Since January I am calling them every 2 weeks and is the same information, that an outside company will contact me and no one did. Its already 14 weeks and I did not received from that a letter or even form to fill in. Did anyone had similar problem? They mention that they will backdated me all payments but I struggle financially already, specially that I am not working a year... I know taht I will need to provide 2 doctors opinion but for me its looks like impossible. My GP is sending just sickness notes and I had 2 psychiatrists appointments with 2 different doctors without any prescription. Any suggestions? Its very depressing

Hi Kaya
I'm not entirely sure what you have filled in - so forgive me if I have misunerstood what you are saying.
You say that you applied for PIP back in November. Did you fill out an initial form (PIP1 over the telephone or by post) and then get sent a PIP2? (The PIP2 form has 15 questions and you give details of your daily living needs and mobility needs and send in any medical evidence you have). It sounds as if you have been told that an assessment provider is going to contact you, but if you haven't filled out the PIP2 form, you will find yourself at a disadvantage. They should contact you about a telephone assessment. For some people, this is taking a long time. 14 weeks is a long time, but unfortunately, it is quite common at the moment because they have a backlog.
You say that you need to provide 2 doctors opinions, but you can only give evidence that you have and if you have a GP and a letter from a consultant that will be fine.
Do come back and ask if you have any further questions.

Thank you for your reply. Yes, I applied for PIP over the phone, they done some questions through. They did not send me any form (PIP2), so I did not fill anything yet. They told me that someone will contact with me to check if I am qualify for the PIP. I told them that I have Settled Status ( as I came to UK 14 years ago), but they don't know if I am eligible for it, as I spend 6 months in Poland for a treatment. It's looks like they just left it and no one cares.
Could you tell me if I can choose a video conversation not phone assessment as my symptoms are very visible?
Thank you for your help.

Dear Kaya, sorry to hear of the problems. If you are worried about having enough or good enough evidence, here's what to do.
Look at the part of the Guides on here about diaries. There are sample entries so you can see the kind of thing you might write. There's also a template [= diary blank]. Use a diary to show how you struggle with whatever you cannot do to the standard of four reliability issues as listed by Gary.
1] Safely - [you could argue that being in pain while walking means that you are not doing it safely, especially if you are unsure on your feet as a result of it] or any other danger for any descriptor
2] To a necessary and appropriate standard - [again you could argue that being in pain while walking means that you are not doing so to an appropriate standard, there is Case Law in this area]. for any descriptor.
3] Repeatedly as appropriate for any descriptor eg can you walk a distance again and how long would it be before you could?
4] and in no more than twice the normal time for any activity.
I think a diary could be especially useful in your case as the NHS couldn't help, so your issue with PIP is much more about the descriptors in your life [it is supposed to be for everyone anyway], than evidence from puzzled doctors. Assessors believe diaries more than you might expect.
Hope this helps,
Denby

Hi Kayla
The question you ask is a bit of a mine field and you need to seek advice from a Welfare Rights Organisation who can ake all your relevant information into consideration. You can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk
To apply for PIP you must be habitually resident in the Common Travel Area, be present in GB and satisfy the 'past presence test' ie have been present in GB for not less than 104 weeks in the last 156 weeks, there are conditions where the test does not apply.
As BIS has stated in her post, when you contacted PIP by phone, it would have been the PIP1 form you completed over the phone, DWP should then send you PIP 2 form .
You may want to get your MP involved to find out why you have not been sent the PIP 2 form.
You can ask for a video assessment, I don't know anyone who has had a video assessment, they are quite rare. There may be some members on the forum who may have had a video assessment.
