Hi
Is anybody able to help us understand the implications if you are outside the UK for more than 28 days.  We have bought a holiday home in France, as I am more relaxed there.  It will require quite a lot of renovation. There may be occasions when we need to be there for longer than 28 days for work to be completed, as the French artisans are not always good at keeping to appointments and work schedules.  We asked DWP (both ESA & PIP teams) if they could help us get a good understanding but apart from saying we needed to complete a form in advance and send it in they said that it was then down to the decision maker whether or not payments would be stopped until back in UK. They were unable to say whether only one period was allowed in the year or more.  Understandably,  my husband is my carer so I have to go  with him.

It is 13 weeks for PIP and 4 weeks for ESA. The day you leave and the day you return should not be counted.

See www.gov.uk/claim-benefits-abroad/disability-benefits

If the claimant is only receiving Contribution Based ESA then the claim is usually suspended if the claimant exceeds the limits, if they are only receiving Income Related ESA then the claim will be closed and as a new claim would be required, this may require a claim for Universal Credit.

The law on this is black and white on this subject, so if their absence extends to more than 28 days even if it was originally planned for less, then, their ESA stops.

I would seek advice from your local Welfare Rights Organisation to clarify your rights.

Hi Gary,

What happens if a claimants receives both rates of PIP, and is also in the SG group IR ESA ?

Being in the support group will make no difference, unless you are going abroad for medical treatment and you are in receipt of CB ESA, in which case seek advice from your local Welfare Rights Organisation.
