Disappointed (understatement) in the outcome of this case
There were people claiming the long term sickness element on Universal Credit at the time, did they get the uplift? Because I can't see the difference in ESA and being "on the sick" claiming Universal Credit.
Makes my Blood "boil", which with my Health isn't a good idea!
I hope they find a way to appeal the decision.

Remember it s only a high court decision, this decision could be appealed several times before we have an outcome.

Discrimination pure and simple. The judge is supporting this as the gov is using it as punitive action, in an attempt to make people think about staying on legacy benefits.

It's also discrimination by saying that those being made unemployed, by no fault of their own, deserve help to adjust in a difficult time. So exactly how does that lie with human rights regarding fault , cause and effects when unable to work, what is the difference?

Anyway I watched all this when they launched the help at the start and it was clearly given to support those on benefits, all those, according to the announcement, who would find things more expensive due to pandemic restrictions and lockdowns. This included talk about helping disabled people who would normally go to centres to avoid increased food and heating costs, additional communication costs; phone, internet, equipment. If it was only to help newly unemployed then it could very easily have only been given to new claimants.

Very convenient that they couldn't find a judge to hear the case for weeks then when one finally pops up, he is none other than Mr Justice Swift, formerly the First Counsel to the Treasury!

All I can add to this is I tried putting a post up regarding this exact situation in how out of order this is, one of the nice moderators asked Owner of B&W Donnison, he Steve sent me an email detailing why they could not have it posted, as it was very much to the bone and I don't blame Steve or the moderator not allowing it to be posted.

I no one of the claimants that's made this all possible we've been disgusting it further the are going to appeal this decision they are absolutely astounded from this outcome as Gary points out it was down to this judge and friends in the right place, I won't go into the ins and outs in what I want to say you will all need to draw your on conclusions i what I mean.

In totally unfair how this was, and has been conducted, this government only wanted new claimants that started on UC for loosing their jobs, as is well documented everyone ended up getting, it that was all on UC?

The simple fact they wanted legacy benefits claimants to move onto UC under what is called the Natural Migration thus loosing SDP etc.

This is a very wrong decision and there's plenty of grounds and faults that have be made regarding this out of order decision.

This won't be the end of this that I can tell you all. I find it hard to accept this has happened?

yes those of us on contribution based esa are conned once again. We paid into the system, hence why we are on cb and not ir, more
or less, along with supposedly we have other monies coming in, however we are not eligible for any of the extras, or the £20 uplift. Just because we are on cb we are very much penalized. Our income can just be marginally over the threshold, however we get nothing whatsoever. We still have to pay for everything and as being disabled, often we feel the cold more, need in some cases different foods and often need the heating on for much longer as cannot keep warm by exercise. We are very much penalized
