Effect of moving to different borough when on ESA

Am asking about family member in ESA support group who owns flat and gets service charges paid by DWP.
If sells and buys flat in different borough with no service charges - does that count as a "New Claim" and they will be transferred to Universal Credit? Very worried - so whatever the answer you give - are you certain? Do not know where to get an official answer to this question. Have tried phoning the Universal Credit helpline but it now asks for details of person involved before you can get through to anyone.

Good afternoon Zonky,
If you move within the same Local Authority then you should not need to claim UC.

If you move to another Local Authority then you need to make a new claim for Housing Benefit then this will trigger a transfer to UC unless you are currently in receipt of the SD Premium.

You could telephone the DWP and check what would happen regarding the move , it could be possible if you were there with the family member to provide there details and they could then request for the DWP to talk to yourself to help you with the answer you need .

Just to clarify...

This is no longer the case, this block was lifted on 27 January 2021

Whether you get the Severe Disability Premium of not if you move to a new local authority then you would need to make a new claim for housing benefit which means you would have to claim Universal Credit.

A top-up payment called an 'SDP transitional element' has been added to UC for SDP claimants who move to UC.

Thank you Katherine. But my family member will move to a different borough and NO LONGER CLAIM ANY HOUSING BENEFIT. There is no SD Premium. I do think that surely if they are in the ESA Support group receiving help with housing costs (service charges are called housing costs - not housing benefits) and move to different borough and CEASE asking for housing costs they will remain in Support group since they are CANCELLING their housing claim. I will most likely have to phone the DWP as you suggest.

Hi Zonky

If you need any advice to do with housing then you should contact Shelter helpline: 0808 800 4444, they will be able to give you the answers to your questions.

The answer to your original question is 'No', if you do not have to claim a means tested benefit such as UC or HB then it will not count as a new claim, you only need to inform DWP of a change of address.
