UC WCA Face to face appeal hearing

Thank you for the links. I decided to give them a call this morning to send me the full reason as to why I have been refused. The advisor was blocking me until I said I am recording it. Then a case manager came online and again I had to explain what’s happened. That my PIP was ended because my visa expired. But I have applied for an extension before the expiry date and there I have continuation of leave until formally refused. He kept blocking me and I said listen I am not going to get into an argument. I need a full statement of reasons from the decision maker why I have been refused. If it is because of my visa then you have applied the law incorrectly (for anyone out there claiming PIP and on visa or going through this situation - go on google and type ‘ADM Chapter 2: C2.). If it is because of my medical conditions then you have failed to reassess me as my conditions have stayed the same and you have previously awarded me based on that, therefore accepting it. They asked me if I recorded all DWP calls and I said yes and they proceeded to tell me I can only use it for personal use. Anyway, I also mentioned that If I appealed as they wanted me to, I would win because I have strong evidence and that I will get the higher award. After a couple minutes of wait. They said we have decided to extend your award for 1 year then there will be a review. I said thanks.

I hope this helps others. I would say do give them a call and state your case even if your MR has been refused. If I appeal, I am confident I would win but at the moment its too much for me.

Thank you for taking the time to write such a comprehensive report on your experience at the tribunal.

You must be so weary of all of the DWP's hurdles they want you to jump through. Please keep going - I am sure the PIP situation will be sorted.
