ESA WRA Group Appeal was created by Diana
Hi, I have received ESA for 365 days which ended in December 2021. I had a telephone WCA in November 2021 and scored 15 points and, at this time, the DWP decided that I should, although not fit for work currently, be placed in the WRA Group which means my payments have stopped. I am currently appealing this decision.

I had a telephone call from the Job Centre on 07 Feb 2022 where the 'woman' on the phone informed me that this was just a call to gather information and set Claimant Commitments and that my actual 'Work Coach' would make an appointment with me at a later date. Following this call, I received a letter from my 'Work Coach' (A man!) saying that HE had spoken to me on 07 Feb and agreed with me that my work commitments are:

1: tell Jobcentre Plus about any changes in my circumstances
2: only give information that I believe is complete and correct
3: send in fit notes

These commitments will apparently be reviewed in 12 months.

My last employer, NHS, has retired me due to ill health and have decided that '...in all probability...' I will not be able to do any paid work for anybody before my State Pension Age and awarded me Tier 2 Pension Rights (this is very small as I only had 2 qualifying years contributions) and stated that I have satisfied SIHC.

I have tried through this site, in the Help section, to find somewhere or someone to look over my specific case to tell me what chance I have of success but I think the link is not working. Have you any suggestions?

Thanks in advance.

Hi Diana

Welcome to the forum, you might want to have a look at the following FAQ which explains where everything is.

Welcome to Benefits and Work

We do not give specific advice, if you need specific advice we would recommend that you seek help from your local Welfare Rights Organisation who can take all your circumstances into consideration; You can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk .

We do have excellant guides to help you with your claim/appeal; www.gov.uk/employment-support-allowance/how-to-claim

In regards to claimant commitment The conditions for claiming Universal Credit are set out in a "claimant commitment" that most people will have to accept at the beginning of their claim. If you are part of a couple, you will each have a separate claimant commitment that may be different from each other's.

People who may not need to accept a commitment include those who lack capacity, those who have exceptional circumstances  where it would be unreasonable to expect them to agree a commitment (this is decided by the work coach on a case by case basis), or, from 15 February 2022 they have a terminal illness and have less than 6 months to live.

There are 4 conditionality groups:

* Group 1. No work related requirements
* Group 2. Work-focused interview requirement
* Group 3. Work preparation requirement
* Group 4. All work-related requirements

Any work pension you receive will reduce UC £ for £
