PIP and the LAW was created by bigG
Hi All, i have been receiving PIP since i was 64 years old, i was receiving basic for living and mobility, in 2019 my conditioned worsened so as per DWP guidelines i told them that it had worsened and applied for a review of my PIP, i filled in a new claim and i had a face to face interview with an assessor and was waiting for the decision, i the received a phone call from the DWP telling me that the law precludes me from any uplift in my PIP, now even if i cannot do anything for myself or end up housebound there will be no more help, so if you are under retirement age and need further help make sure you get a claim in before retirement

Hi bigG

What you were told is not exactly true.

You cannot be awarded the Mobility as a new or an increased award after you reach the relevant age with the exception of the initial transfer from DLA to PIP where the age restriction is suspended.

If you have a Mobility award before the relevant age then you can continue to receive it after as long as you continue to meet the criteria but if you are in receipt of the standard component you cannot apply for the enhanced component.

The relevant age is State Retirement Age.

If your condition deteriorates and your needs for assistance with daily living increases, you can ask for a supersession and qualify for the standard or enhanced rate of the daily living component in the same way as if under State Pension age.
