PIP mobility component when in a care home

PIP mobility component when in a care home was created by Liz Bamber
I have tried to find the regulations about being paid the PIP mobility component while residing in a care or nursing home. Called PIP and the answer was as the person was part funded by health and part by Social Care he did not qualify to be paid his mobility component. I argued the percentage of health is not 100% and therefore he should/could be awarded his mobility component. Any ideas?
