Hi can you please advise, i received my M . R . Decision back today and still just been awarded the same standard rate, had pages of new medical evidence mental and physical health, it looks like its almost word for word from the previous assessor , the paper work does not look like it has been looked at.
I hear if i take it to tribunal i should attend but i mentally dont think i can , i am overwhelmed with it all, do you think its still worth trying it on paper?

Hi Richmond,
My personal view is that a claimant should always ask for an oral hearing hearing where you can go and explain everything to the tribunal, and they can also see you and eg see how you walk and hear how you speak. Oral hearings are usually much more successful than paper ones.
However, I appreciate that you may feel overwhelmed about attending. If that means your health will be set back as result, then may be a paper hearing should be requested.
If you want to ask fir a paper hearing, please make it absolutely clear why you have requested this and why you can't attend. It is possible that the tribunal may wish to hold an oral hearing even though you request a paper one.
You could see if you try an attend a hearing, on the basis that you could be represented by a benefits advisor or friend/relative who can attend, even if you decide later it really is too much for you to go.

Be aware, if you request a Paper hearing (which you do not need to attend) then you must have your paperwork in order and submit it within the one month that you are given to do so.

Unlike Oral hearings which are taking many, many months to be heard, therefore allowing claimants to submit evidence and testimony up until a couple of weeks before the hearing, Paper hearings are heard without notice and could be heard as soon as the one month has expired, even if you not provided a submission.

Thank you for your advice, I had asked for my assessment to be recorded but they say they couldnt, I had it recorded do you think it is wise to get it typed up and add it to the papers for the tribunal? there are many untruths said on their report. I actually think this has to be the last as I am so overwhelmed and my health is so damaged by the stress of the DWP. Thank you so much for your support and somewhere to turn to.
