Hi
Need to Appeal against a PIP decision
Take off Enhanced Daily Living
To Standard rate.
Also due to being ill health for over a month .
Gone over the month timescale.By couple of weeks.
Unsure about how to go about this
Stressed to bits .
Just having to do this.

Panic not!
Anyone can appeal within the usual 1 month, this is by right. However there is an absolute time limit of 13 months after the date of the MR notice. In order to put in a late appeal, you will need to show good reason why you are late. The more late the better the reason, and hence the less likely the late appeal will be allowed.
You have been ill, and are only a couple of weeks late, so don't worry.
What I suggest is that you go online and fill out the form. See here

You will need to fill out personal details, and explain your lateness. Simply say that you have been ill, you don't necessarily have to explain with what, but you can if you think it will help. You said in your post that you had previously had enhanced rate you could add something like,(if appropriate) 'I have had enhanced rate for X years and DWP have now reduced by benefit to standard rate, even though my health condition/s have become worse/remain unchanged. If my appeal is not allowed I will lose my right to access justice, this is a breach of Article 6 ECHR.'
Under the Grounds of Appeal you can write as little or as much as you want.
You could write this again
'I have had enhanced rate for X years and DWP have now reduced by benefit to standard rate, even though my health condition/s have become worse/remain unchanged.' You could add about how your condition may have become worse and explain why the points awarded are wrong.
However, you could just write the paragraph I've copied and pasted from above, then lodge the appeal now. This will mean no further delay. It will take at least 4 or 5 weeks to receive a set of papers (appeal bundle) and several more weeks until a hearing is fixed. This will allow plenty of time to get any further evidence and send this in before the hearing.
If everything is ready for your appeal now or maybe in a couple of days then you can send in a fuller grounds of appeal and evidence.
If you want to type a long grounds of appeal then type it as Word doc or similar and upload as separate document. The formatting on the grounds of appeal box is terrible. Everything comes out as one long paragraph which is very difficult to read.
