PIP - Is mental health claim after 0 points for physical claim ok?

Hi Everybody.

Previously got PIP Daily Living on physical health grounds. No Mobility.
Went to PIP review - 0 points. Started tribunal process. DWP offered
me Standard Mobility on mental health grounds to stop my appeal.
Carried on to tribunal, paper hearing. Didn't get Daily Living, but did get Standard Mobility
on mental health grounds. That award has now ended.
My new claim is now based on my mental health issues which I did
not give enough weight to originally.
Will the DWP look unfavourably on this change from physical to mental
reasons for a claim?

Hope you can help.

Hi Sunshine569, I'm not a Mod. But I would think as always the really important thing is to put together a well-evidenced claim using the Members' Guides. You have to show how you are affected on a clear majority of days, not being able to do the descriptor things safely if at all, to a good standard, and in a normal time, and as often as reasonably required.
If your physical problems are not as bad as they used to be, lucky you. But if they're actually the same, your form will show the physical issues too, so it won't even be a 'switch'
And when I say well-evidenced, a diary you write yourself [or a friend/relative writes] of a week or two is actually really good evidence and there are examples and templates in the Guides.

Hi Sunshine569,
Decision making at DWP is a random process. It shouldn't be, but it always appears so. I suggest you fill out the form explaining all your disabilities, physical or mental. You stress that you have had these disabilities X years, well before the previous award, but you didn't make a further appeal. Just stress how long you have had each problem.
Don't worry about how DWp made its decision last time it clearly didn't get the correct decision according to the tribunal, and unless your disabilities actually changed, nor did the tribunal!
You may want to refer to the members guides to help write your new form. Make sure you use plenty examples to illustrate the difficulties you have and what goes wrong.
Physical and mental disability is equally valid. PIP is awarded on the basis of not being able to do the various PIP activities to the required standard, or at all, due to a health condition.
