I have just received my PIP renewal. It is the PIP.1043 which is suspect is the new version?
It asks the following:

Tell us if something has changed and approximately when
Tell us how you manage this activity
Tell us about any changes to the help you need.

In my case my conditions have not improved and have stayed the same. So in my case would be okay for me say no changes but send detailed account of how each category affects my daily living?

In my last review the assessor made a false declaration about my mental health advice that there was no evidence of specialist input or medication even though I had supplied reports from my counsellor and letters from my GP stating this condition. My GP has been kind enough to provide me with a letter specifically for this and also mentioned the medication being taken. I feel I need to make DWP aware of the false declaration in my last review but I am worried they may hold this against me.
I have already prepared in advance a detailed description for the categories affecting me so it will be a case of printing and attaching these to the form.

I am also a vulnerable person as identified by the NHS during the covid pandemic and I have several letters from at various stages of the pandemic. Can I send a copy of these letters or just one to DWP so that they aware of this.
The have given a deadline to return by the 23 April which is not even a month!
Can someone please advise so that I can get the ball rolling?

Hi Harishah

The way you want to tackle it - sounds absolutely right - tick no change and give them details of how your conditions affect your daily living against each part of the criteria.

It's up to you if you want to say that the assessor was mistaken last time in thinking you didn't have specialist input. You did then and you still have it - as per the evidence provided. Do not call the assessor 'a liar'.

Regarding the letters about being a vulnerable person - include copies of anything which you think is relevant to your PIP claim.

Your reply is very helpful.

In hindsight you are right in calling the assessor a "liar" although in anger one just cannot help using such words. I will make slight changes to my wording in this respect.

Hoepfully This time around I will get a paperbased review becuase for the past few years I have been called for a face to face eventhough the evedence is there that there will not be any miraculous improvements in my conditions as these are life long and they have an extensive list of my medical reports. I have pointed this out to DWP on this occassion and hopefully they will take note of this?

Hi Harishah,

Yes, BIS is perfectly right in saying not to refer to the assessor as a 'liar". This will make your argument look weaker.

I learned this the hard way. It caused me even more grief and hindered me even more in my path to getting right decisions in the past.

It was around 3-and-a-half years ago when the penny finally dropped during an MR to argue my case when I received zero points throughout the entire assessment report.

I used phrases like: ' I believe that the assessor misreported my condition to such an extent that it misled the decision maker to come to the wrong conclusion.' I varied the way I worded each descriptor I was contesting - and finally I had my old award reinstated.

Be firm but diplomatic is my advice to anyone who unfortunately find themselves in this position.

One point that has come to light from my last award is the statement that the decision maker had made and it was:

“I have considered what your needs are on the majority of days. I cannot consider awarding you PIP for any help you need for anything not covered by the daily living or mobility activities, including ability to work, being near to a toilet, getting in and out of a car, stairs, use of taxis or public transport, walking on slopes or uneven surfaces and weather conditions”

I do not agree with and I beleive these factors should be taken into account if they have an affect on my daily living or mobility activities. I am not sure if this is in the PIP guidance for the the decision makers?

Can someone clarify this as I want to make a point of this with my current review.

Hi Harishah

Both phrank and BIS make good points in their posts.

When arguing against a previous decision makers decision you do need a copy of the assessors report called a PA4 so you can see what was written about you and how the decision maker came to their decision.

I know on the forum we keep banging on about getting copies of the assessors report but it is so important to get the report whether or not it is for PIP or WCA.

To answer your question, you do need to see a copy of the report, the person is offering an opinion, you need to explain why that opinion is incorrect, if you can match it with any supporting information you sent in so much the better.
