New style ESA and UC was created by Cathy
Hi, I am on new style ESA (support group) and PIP basic component, my husband works full time, but now is due to have surgery and will be off work on SSP for an extended period of time. If he applies for UC will i have to move across on to his claim and will I loose my claim to NS ESA and cannot go back once he is fit for work again? TIA

Hi Cathy

Welcome to the forum, you might want to have a look at the following FAQ which explains where everything is.

Welcome to Benefits and Work

NS ESA is a contribution based benefit, as you are in the support group then it is paid indefinite until you are next assessed.

Whereas UC is a means tested benefit. You will not have to move to your husbands claim ...... but ..... your NS ESA will be taken into consideration when your husband claims UC. so the answer to your question is no you will not have to stop claiming NS ESA.

I would advise your husband to seek help from your local Welfare Rights Organisation, who will be able to take all your circumstances into consideration: advicelocal.uk
