MR Request for hearing loss law? was created by Tina
Hi,
I have recently been awarded PIP and back dated to Sept 2021. I have requested a MR as I didn't receive any points for mixing with other people for which I need communication support for hearing loss (registered disabled for).
I have read your news post from the 14th April regarding hearing impaired washing and bathing safety, however, I received 2 points for this descriptor for needing a shower seat (arthritus lower back) but none for washing and bathing safely for hearing loss. The law should have applied to claims after 17th May 2021.
Should I write to them again now or wait until I have the MR Back?
Any advice would be much appricated.

Hi Tina,
Hopefully I can answer the queries you have made. Firstly you can only get one set of points from each descriptor section. As you have achieved 2 points for needing a shower seat, even though you may well qualify for points for needing supervision, this is also 2 points so you can't get any more points under this descriptor.
Just because you have hearing difficulties, and can get points under descriptor 7 doesn't mean that you will automatically score under descriptor 9. You mention 'communication support for hearing loss.' This would potentially give rise to points under 7.
Why do you need help under 9? Why is help under 9 different from the help you need under 7?
Have a look at this case which may help clarify things.

You will need make sure that you can justify the help under both descriptors.
If you feel that you can gain more points under descriptor 7 or 9, by all means write again to DWP. However, for the reasons given above I do not think you will get more points for washing but I guess you could get alternative 2 points for supervision instead.
I hope this helps.

Hi,
Thank you for your informative reply. I have requested the MR for Mixing with other people as I will not go out on my own or indeed receive deliveries at home alone, as there have been many occassions when even wearing hearing aids I cannot hear what people are saying to me. So will not have that embarrassment any more! I did explain the difficulties I encounter on the PIP application form.
Regards
Tina
