Good afternoon, I am after some advice please. I had my assessment several weeks ago, I rang up for a copy of my assessment and it's absolutely awful, the spelling is terrible and there are things in there that I didn't state, completely made up and I am feeling really deflated. I rang Pip helpline today for them to tell me I haven't been awarded and scored 0 on everything, which is complete and utter rubbish. Alot of the stuff that has been wrote is completely untrue and I am so disappointed. They advised me I should receive letter tomorrow stating I haven't been awarded anything. What are the next steps please and how do I fight this? I recorded the whole conversation. Best wishes. Jade

Hi jadesnookes

I am so sorry this has happened to you. It doesn't help very much, but you are certainly not alone.

When you receive the decision letter - you can ring up the DWP and ask for a Mandatory Reconsideration. You have one month from the date on the decision letter to do this.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I can walk 50m, I can but they have failed to document that I have to stop every 10m for a rest due to breathlessness and pain."

Use your recording to remind yourself of what you actually said, but at this stage, there is no value in telling the DWP that you recorded the conversation as they will not look at it or take any notice of it. If you had to go to appeal - you can use it.

Go through every question about why you think you should have scored points and refer back to the evidence that you have.

In terms of the quality of the report - don't get bogged down in the spelling mistakes. You can always put in a separate complaint about the quality of the report. It's not professional for them to issue a poorly spelt report, but it won't actually gain you more points. If you want to mention it, just add a couple of sentences at the end of your MR.

You can find more details about how to challenge a PIP medical report and more details in how to write your MR from our guides. if you look under the PIP appeals heading

Hi, I feel for you. I applied march 2021 and had my assessment Aug 21. I then got 0 points for everything.

I asked for an MR but didn't know what I was doing and didn't really have much input from citizens advice for that part.
I still had the same decision so I got citizens advice to sort my appeal out which was December 2021.

I then got my tribunal date which was this Tuesday just gone. I won with standard rate for both living and mobility and I wasn't even in the court room 5 mins. They said they was really sorry for my situation and they could see will all the evidence that I wad entitled and had already made the decision. I just needed to decide if I wanted to go with the rate they said or refuse then go through it all.

I have got 2 elements missed out of my decision that could have giving me 4 more points potentially, which my representative is applying for the report on why they came to the decision they made. I'm only 1 point away from high rate daily living:-/

Hi jadesnookes,

I'm so sorry you've been given the zero points assessment brush-off.

If it's any consolation exactly the same thing happened to me four years ago.

My assessor completely dismissed any evidence and to be frank, lied and misreported the whole sorry episode of an assessment.

I was so fired up I fought my case and got my old award back afer a very stressful MR appeal. I think I got 21 points which was standard daily living and the higher mobility components.

I am currently helping a friend who unfortunately has suffered the same fate.

All I can say is read through the guides thoroughly and also any posts relevant to your case and ask as many questions as you need to.

I wish you the best of luck, and please don't give up.

I hate to hear of cases such as this.

Regards,

Phrank.
