Should I be receiving income based ESA was created by 1legmummy
Hi - in the hope of not sounding naive, I was hoping someone could answer my question?

I receive contributions based ESA and I have been in the support group for approximately 5 years.

My husband works 23 hours a week and I receive high rate PIP care and mobility.

We receive tax credits working and child and I have a 15 year old son who has a disability but no longer qualify for DLA. I will be applying for PIP once he turns 16.

When I complete my tax credits end of year I declare my contribution ESA but if I receive income based then it’s not taxed.

As far as I can work out I qualify for income based and on my award form it says I qualify for income based but receive cont based as I paid enough NI.

Should I be on income based? I don’t work, my husband earns £9000 a year and we have £3000 in savings

Many thanks Emma

Hi 1legmummy

CB ESA is not dependent on your husbands earnings, if you claimed IR ESA then your husbands income would be taken into consideration.

We cannot answer your question as we do not have enough information, you may want to contact your local Welfare Rights organisation: advicelocal.uk or you can check your benefit entitlements using a benefit checker; gov.uk/benefits-calculators
