hi this is not a directly based benefits question, but my trouble i am having involves my benefits, so i thought if i didn't ask i wouldn't know if anyone could help, i know people will say speak to the cab etc, but on the off chance someone has any knowledge on my problem i would be grateful for any ideas'
any way i am in the support group contribution based, and i also receive pip, my wife has told me she is leaving me when she retires which she say's is in about two years time, she say's she is leaving me to live in the house and doesn't want a divorce, but she would say that, as far as i am concerned she could leave at anytime and sell the house after she leaves, how can she sell the house whilst we are still married? well i haven't £310 an hour plus vat to pay a solicitor to find out , to keep a long story short, we will have been married for 28 years in september, i moved in to the previous property which she owned on a mortgage' we married in 1994 the same year i moved in , when we had children she wanted to buy a bigger house, so we bought a house with the equity from the marital home plus a bigger mortgage, she says now i was on the mortgage as a contributor, but i didn't find out that i wasn't on the deeds until last year, i registered my marital home rights with the land registry on the leasehold, as they said i didn't need to be on the freehold as this would stop the sale of the home anyway i also set up a property alert, on the deeds my wife is down as the sole owner, something i would never have agreed to if i had known, i have physical and mental health problems, i have been on benefits since 2003, we bought the house in 1998, although i have always had mental health problems, she was aware when we were married, she has always been the alpha in the relation ship and has made all the decisions, the land registry won't give legal advise, and i don't expect that on here, just an opinion, i want to get divorced but i can't afford it at the moment, can she really have 100 % ownership after 28 years of marriage? i have always contributed what i can, although she has now stopped taking money from me, don't know who else to ask, so any opinions really appreciated, i am terrified of being made homeless or put in some grotty council flat miles away, apart from the fact i don't get enough money to run this house by myself, i want a divorce and hopefully get enough to get the cheapest maisonette in my area, long question, i am sorry, i haven't even got in to who will care for me, i need help daily, it is making me feel suicidal, honestly not just saying that, i had suicidal thoughts before all this stress landed, i hope you post this, and i can add further info if needed, i am also in receipt of a small company pension of £91 a week, i turn 58 in august, my wife turned 60 may just gone, i could possibly run this home alone if i cut down on everything, such as the internet cable tv etc, i feel she has taken advantage of me due to my mental health, i make bad choices, and of course although i have been in receipt of benefits for 19 years, i constantly fear losing them, as i am sure many other people on this forum will identify with,
thanks in advance

Hi freefee

Thank you for your post.

Your question is outside the remit of the forum, as it is housing related you will need specialist help, I would advise you to contact Shelter helpline: 0808 800 4444 they may be able to give you specialist advice or point you in the right direction; www.shelter.org.uk
