DWP have they forgot their process was created by Caz1
Hi,
I’m really confused, could someone please explain
Last September I rang DWP and told them that my mobility has got worse and I am letting them know because it says that’s what you have to do, I did not mention that my daily living had changed
I was told I must have a telephone assessment, they didn’t say why
I had this assessment and the person didn’t explain anything so I thought this was the norm when she was asking questions about daily living and not my mobility the only thing I wanted them to look at
They have decided that my mobility will stay as it is, and my daily living benefit will stop, which I didn’t ask them to look at
Is there anything I can do about this
Thanks Caz59

Hi Caz59
I think the only thing you can do is ask for a mandatory reconsideration..
I guess everyone always needs to keep in mind that any touchpoint with DWP may, and probably will, be an excuse for them to review the whole claim not just the current changes.
When you submit the MR make sure you evidence every part of your original claim as if you are starting again. Don’t assume “they’ll already know this”.
If you didn’t keep a copy of your original claim then you can request one from DWP.
I do have to warn you that this will not be a speedy process.
Here is a link to a guide that may help

Good luck and let us know how you get on.
Regards
Pete

Hi Pete,
I have gone through all the descriptors and what they mean on this website
It seems that a good few of their reasons are not lawful
They have all my X-rays and reports so they know how bad my osteoarthritis is, they are from 2016, as it’s degenerative it has got worse over the last 6 years, especially my mobility, 6 years ago I Han no cartilage in both knees and severe osteoarthritis and it has got worse
They said that because I can hold on to grab rails there is nothing stopping me getting dressed or needing any aid to eat or drink
It’s quiet ridiculous what they have put, I was always 11 points for daily living they dropped me down to 6 points, even though it’s a degenerative disease I have
I am thinking of taking notes and advice from this site and doing it online to send to tribunal
Thanks for your advice, it has helped ………….Caz

Hi Caz,
My partner has arthritis so I am sympathetic.
You probably know this but just in case, do make sure you mention all the aids you use to enable you to manage. Perching stools, fat cutlery, even embarrassing stuff like bottom wipers, easy open shoes and clothes. Make sure also that if you have help getting dressed and undressed you mention this and get letters from your helpers.
Good luck
Pete
