Severe Disability Premium was created by Simonalex
I need advice as my case manager at the DWP is saying I am not entitled to Severe Disability Premium when after reading the governments website I think I am.
I just had a tribunal appeal for PIP upheld, I was awarded the standard rate of mobility and daily living allowance. This was thanks to the advice I got on this site.
The government website says that if I get the PIP daily living component and am living on my own with nobody claiming carers allowance for me then I am eligible for Severe Disability Premium to be included in my Universal Credit by adding it to my JSA. I am currently unemployed.
The DWP manager says that as I was considered fit to work after an assessment for ESA last year I am not eligible for any Disability Premium. Also that my claim for Universal Credit has to have been made in the last month. I have been on UC for some time getting Income Support.
The government site only mentions ESA as one of a series of qualifying benefits for Severe Disability Premium along with PIP daily living component.
I don’t know what to do as the DWP case manager is insistent that as I don’t get ESA I’m not entitled SDP despite what it says on their website.

If you were in receipt of legacy IR benefit before you claimed UC, then you would be entitled to a SDP, there is no SPD for UC but you may be eligible to claim transitional SDP Element depending on your circumstances.
You do need to seek help from your local Welfare Rights Organisation; you can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk
