Advice needed- have submitted appeal to tribunal

Hello,

I have submitted my appeal to the tribunal online after receiving my mandatory reconsideration notice.

However, please can someone help me with the following questions please:

1. Apart from Citizens Advice, or local Welfare Rights - is there anyone on this forum who can support me writing/completing my tribunal?

2. For my appeal hearing, I said I do not want to attend it because the thought of going to something like that just makes me anxious. Should I have put Yes I want to attend? I will fill my MR appeal in and submit that as evidence for the tribunal along with other medical evidence e.g. letters with my ADHD diagnosis etc.

3. I have received a text saying that my PIP appeal has been lodged and that DWP have to respond to it by the 17th August 2022, is there any way I can speed this whole process up and have my tribunal earlier?

4. Do I have only 1 month from when my mandatory reconsideration letter was dated for me to submit my evidence for the tribunal hearing?

There's so many different forms etc and I just have no idea what half of this stuff and process is, but I'm struggling with my ADHD and mental health and it's coming to a point where I need my PIP sorted ASAP so I can access the mental health, coaching, private support etc I need (but cannot afford) before it's too late.

Hi M

I will try and answer your questions.

1) Unfortunately we do not provide casework, we can help claimants/forum members who raise a question, to get help you need to contact your local Welfare Rights Organisation; advicelocal.uk , if you live in social housing then your landlord may provide a service.

2) At this moment in time most Tribunal hearings are done over the telephone, I have not yet been to a Tribunal in person in over 2 years, all the ones I have attended have been by phone, you do need to put in a good submission to make the Tribunal easier.

3) You can only speed the process up if you agree to attending a hearing at a moments notice, this usually happens when some calls the Tribunal Service and cancels their hearing. I would only recommend this if you are super confident with your submission and able to represent yourself.

4) You can submit supporting evidence up the date of the hearing if it is a face to face Tribunal, if it is a telephone Tribunal they usually ask you to submit additional supporting documents two weeks before the hearing date.

What you must not do is panic, that is when everything can go pear shape, unfortunately PIP cannot be rushed.

Hello,

Thank you so much for your advice and reply.
Just to clarify as I am still slightly confused- do you think it makes much of a difference if I attend my tribunal hearing meeting (in person/over phone) or if my documentation is sufficient e.g. my own written statements/medical evidence etc, is it okay to not actually attend it?

Hello M

I don't have the numbers, but you are more likely to win a tribunal if you attend (telephone/face-to-face, video) as it means the tribunal has the chance to ask any questions they may have over your evidence. However, there are plenty of people who choose to have a paper-based decision.
