PIP reassessment 1 year early and no form

Hello,

I am looking for some advice as i have been out of the loop on PIP developments but it appears that PIP is massively behind on reassessing. Yet I have been called in a year early for mine? I was given an extension so should not have been dealing with it for another year.

Not only that the only reason i knew was becaise i got a letter telling me that if i did not return my 'form' they would stop my benefits, no form was sent. Someone called on my behalf and was told that a another form would be sent and a slight extension was given to return it. NO form has been sent, there is no reason to suspect Royal mail are failing to deliver my benefit letters.

Why would i be called a year early when everyone is struggling to get assessments done from last autumn?

I have had letters 'go missing' from DWP in the past, a data request showed what they stated was sent was not several yeasr ago. No forms are being sent and its like i am being deliberately put in a position to have my PIP stopped. Is there evidence of the DWP doing this in general?

Hi Rococo

You are the second member tonight who has complained about non existent post.

I am not sure what the answer is apart from chasing DWP regularly if no form arrive.

In regards to being told you are up for a review early, DWP can review your claim at any time, prior to Covid , claimants were reviewed 6 months before their end/review date

I do not think the review form is online but it is a question you can ask the DWP if your form fails to turn up.

Hi Gary,

thanks, i now know they can recall people early, though it has never happened to me. But it makes no sense to do so with a huge backlog, especially as my extension in the first place was during the pandemic as they anticipated long waits? Is there a regulation that mentions this being able to call people at any time? also what if the award period was made by a tribunal, they can overide that too?

They have had this form requested now three times, by an organisation that supports benefit claimants, is this not grounds for a complaint? I am not able to call them myself and the charity that was calling for me said they do not have the time to do it again as they deal with appeals and reviews.

Hi Rococo

It is the PIP regulations that the DWP can review your claim at any time. If you win your claim via a Tribunal then end date is set by the Tribunal. We have heard from many members who won at the Tribunal and discovered they have not received a renewal notice only when their claim stopped. If you win at a tribunal you need to make a note of the date when your claimis awarded to and then contact DWP 6 months before the end date.

Hi Gary,

as i have no form and they keep telling the benefit advisors they wil send one out then dont, is this not grounds for complaint? I am now going to miss the deadline and my benefits stopped. My advisors will not be able to call them again to chase as they are booked up with tribunals and appeals and i cannot get an appointment before deadline.

I'm sorry this has happened to you. Yes, not receiving a form, if they have said more than once that they are sending it out and haven't, is the basis for a complaint. They could blame the post once - but not a second or a third time.
