Upper Tribunal? was created by lauren
Hi there, am still waiting for DWP response to my Tribunal appeal.I have sent everything in I can think of bar the kitchen sink as evidence! Apart from my GPs letter. This is because she has told me that she doesn't do them but has told me that if DWP send her forms to send in she is happy to fill them in.

My questions are what if the DWP deny my appeal because there isnt a GP Letter? Should I then take it to upper tribunal? Also I have some new symptoms and on some additional medication. Should I send in the new information. The new information is about something which severely effects my movement.

Thanks again!

Hi lauren

Your post is a bit confusing, DWP cannot deny your PIP appeal.

When you appeal a decision you either complete a SSCS1 form; www.gov.uk/government/publications/appea...-decision-form-sscs1 and send it to HMCTS or you complete an online application; www.gov.uk/appeal-benefit-decision/submit-appeal.

You cannot go to the upper tribunal until you have been to a Tribunal and disagree with their decision.

They will not look at your new conditions, they will only be interested in your condition when you had the assessment.
