Under the legacy system, official errors were not recoverable, unfortunately the Government chaged the law, under UC even if DWP make a mistake it is still recoverable, although you can write to them to ask for a write-off if the recovery will cause you severe financial hardship.

Hi Gordon, well after months of my phone and leaving notes in my journal and me pushing to keep telling them that what we were getting was wrong being overpaid,


"My colleague asked me to review your payment for this month and you are correct there was an error. I'm not sure why this has occurred because your payment was system generated."

I was told on the phone that this payment was correct.
But something just didn't sit right with us so I kept asking for someone to talk to me face to face about this and being told I can't do this and a few weeks ago I did manage to get to talk to a lady at my local centre she promised me she had 3 people looking into it and said she will talk to me very soon about it. I have not heard anything after 3weeks I thought well I must try and find out what's going on here. well after many journal entries, I manage to get hold of a lady today.
The letter today saying been overpaid by £1637.43 26/05/2022-25/11/2022 .
I talked to her said not happy about this after many many times of being told it was correct and me checking every month she has told me she has now sent the Mandatory Reconsideration. The Decision Maker will contact you here in your journal with the outcome of their decision. please can anyone let me know do I stand a chance here I really worried as we are now not going to be getting any UC at all
I have tried for the last few months to get to the bottom of this
What do I need to do ??

If your claim was under the legacy system then the overpayment would be written off as an official error ........ unfortunately under UC regs there is now no such thing as an official error even if the DWP make a mistake.

If the overpayment will cause you severe hardship you need to write to the DWP and ask them to write-off the debt as you contacted DWP on numerous occasions as you believed you were wrongly paid, (try and name the date times you contacted, if it was via your journal then you have an electronic foot print)

DWP did not right-off many debts last year, I believe it was somewhere around 35 cases but don't let that put you off, you could contact your MP to help with the right-off as they will have a bit more clout. If you do ask your MP make sure you have a list of time and dates you contacted DWP about the overpayment and replies you may have as it will help your case.

Being to wonder if closing my carer allowance claim will sort this out, I get my payments weekly and then the UC say on my statement that I have been paid it but when it comes to the decisions they don't seem to take it off again. so I have to phone them every single statement day.
So my thinking is if I don't claim it then it will sort itself out anyway don't matter I still have to care if I get paid or not the only thing we get from UC is our rent pay for and I have them pay my local authority so I don't forget too
I have sent all the past 18 months' journal information and all my journal to my local MP hoping h can sort something out, I Must say in a little disappointed all he did was just( We have sent this on to the DWP for attention.)
Really nothing more than I have been doing for the last 8 months. What am I meant to do I'm getting so very confused please does anyone have the slightest clue as to what I should do now,

You need to seek help from your local Welfare Rights Organisation who will be able to take all your circumstances into consideration when giving you advice; you can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk

I REALLY DON`T KNOW WHAT I AM MEANT TO DO,
I have just gone to look at my UC STATMENT and yet again they have again arranged not to deduct the carers allowance from my statement ....... what am I meant to do I phone them every month, we just had a young bereavement in the family and really don't have the time nor really should I have to after all this time phone them every single month Im so tired of this please help what am I supposed to do ........ just about had enough
