To sick to work on UC but have a property renting out was created by SD
Hi I had a daytime job 9-5pm working from home I am disabled on UC limited capability to work and work related activity so if I am not well enough to work I dont have to look for work. I have high rate mobility and care. I became unwell and took 2 month sick from work and came back I was still unwell however my contract was coming to an end 30th June 22 so I left the job then. I reported to UC that my job ended and I am too sick to work. I now have enough contributions to apply for income related ESA however is this more money than UC- LCWRA if not there is no point applying.
I Own my own house which i live in, In May I bought a house through my limited company so the company owns it not me and it already had tenants this is renting out. I have not drawn any money from the property in divendens or salary at all and there is actually no money left in it as I had to pay for repairs mortgage bills as its a hmo, HMO license etc. My mum gifted me the deposit for the house and it went to me then I put it straight into the limited company account. I reported this a little late as I have been ill so about a month late I did explain this to them.
I spoke to Self employment they first said they need all details of the rental income every month and expenditure they then put note on journal and said they dont need this info as I am not making any money from the property but they spoke to case handler and they class the property as a assett/ capital so they want me to fill in a A64A form. I tried to explain to her that this is not capital or an assett as I dont know the house the LTD company does but she said they still class it as I own it. The house is worth £139000 so does this mean im not entitled to any benefits even though I am too sick to work and I am not drawing any money from the business. I was just getting a UC top up of about £300 when I was working until it ended 30th June 22.

Thank you for your question, unfortunately the question is outside the remit of the forum. We would advise you tyo seek help from your local Welfare Rights Organisation who can take all your circumstances into consideration; you can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk
Income related ESA no longer exists for new claimants, it is also means tested not based on contributions. What you can now claim based on contributions is New Style ESA, this is not means tested or dependent on a partners income.
