I already tried to put a post up about problems with letters, forms going 'missing' a week ago and it was not published. I could have really done with some advice, as the situation is now much worse. I just got a letter today stating PIP has been stopped because ' I failed to get the form back to them' the form that despite claiming it had been sent four times never came.

I have no idea what to do, the benefits advisors are saying they cannot take my case on currently, I have now sent two letters to the DWP. The first pointing out i had no form and to send one via an alternate address, the second making a complaint that the deadline was approaching and i still had no form. Letters were sent because I am unable to call and cannot afford a textphone.

I tried to use an email address online that was supposed to be for hose who were having issues with contacting due to disabilities, that does not work. What are my rights here to get it reinstated?

I also requested my old files from the welfare advice centre some time ago as i had lost all my old PIP paperwork which i needed for form filling, they have not responded to the request, is this a GDPR problem or do i have a right as an old client to get my files?

Hi Rococo

I'm sorry not to have answered sooner, but the forum was closed for two weeks to give the mods a break, and there are a lot of replies with a limited amount of us available.

I know you have tried to write to the DWP, but do you have anyone who could be with you who has a mobile and call on your behalf? You need to be there to give permission - but calling them will likely get a quicker response.

You have already made a complaint, but you could make another one about your benefits being stopped before a response was given to your letter.

You could contact your MP and see if they will get involved.

I realise none of these suggestions is satisfactory when you have been left without your benefits, but there is little else I can suggest.

You should be able to get a copy of any information from the local welfare advice centre. I can't tell you how long it will be before you get a response from them.

Hello,

do you or anyone know how long i have to ask for a review or for a complaint to be dealt with? with the mail strikes the letter took almost 10 days from the date to get to me.

No there is not anyone that can call currently, if there was i would not be looking for alternatives. The advice centre have done nothing.

Hi Rococo

If you are talking about a Mandatory Reconsideration (MR) then it is one month from the decision date on the letter, you can do an out of time MR but you would need a good cause as to why you are applying out of time, the max time for this is 13 months from the date of the decision.

If your MR gets turned down then you can appeal that decision within one month of the decision date, again you can do an out of time Appeal with good cause, the max time is 13 months from the date of the decision. If you try to Appeal after 13 months your Appeal will be struck out.
