We have recently had to move to Universal Credit as I have just reached State Pension age and my wife (who is disabled) is younger than me (61 years old) and as such we are classed as a mixed age couple.
We live in a regulated tenancy which commenced in 1981 and as such have a “fair rent”. While we were claiming housing benefit we were exempt from the Local Housing Allowance, meaning our rent was covered in full. Now that we are claiming Universal Credit, they will only cover the LHA for one bedroom, which leaves a considerable shortfall. I have challenged this and they insist that even though they accept that while claiming Housing Benefit, we were exempt from the LHA, this exemption does not apply to Universal Credit. I have been unable to find a definitive answer online and I’d appreciate it if you could confirm one way or the other before I take this to an appeal?
