My daughter has M.E/CFS and has been studying part time from home ,doing an Open University degree. She gets PIP and ESA. She has also had a student grant. She didnt realise that Income based ESA is taken into consideration and can be reduced. She had a telephone consultation with an ESA assessor. Now a letter has turned up asking her for over £2,700 per year repayments for 3 years of study! She's distraught as she cant pay it.They want £30 a week. We want to appeal the amount . She suffers with brain fog due to the M.E/CFS and had read in a student pamphlet that benefits wernt affected, so it was a genuine mistake. Is there anywhere that we could find a sample appeal letter? The appeals I can find on here are for if you have been found fit for work. Thanks
Thank you for your question, unfortunately it is outside the remit of the forum.
I would contact your local Welfare Rights Organisation or even your local Law Centre for help; you can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk or lawcentres.org
