Hi guys,
So am feeling utterly disappointed that I received my pip letter today saying that I haven’t been awarded anything!I have Charcot Marie tooth and an acoustic neuroma and mobility and balance is a big issue for me.I was feeling hopeful as I didn’t have a telephone assesment it was paper based although they did ring me to clarify a couple of points.anyhow scored 6 points for daily living and 4 for mobility.daily living was 2 points in each of washing,toilet and dressing for using an aid but failed to score anything in preparing a meal because the decision info said “because I reported a standing tolerance of 20-30 mins while I’m at work before I need to sit down that is considered ample time to prepare a meal”.I had put down that I sit on a stool to prepare a meal as my foot pain and balance issues I feel make it dangerous for me in the kitchen and for me to do it safetly I choose to sit down.In regards to mobility I told the assessor that I can walk but I am in pain doing so but said on the decision info that because “I said I can walk around a supermarket at a slow pace using an aid(leaning on a trolley to aid me) that I can move more than 50 metres but no more than 200 metres.I put on the form that I couldn’t walk more than 20 metres which is true because I am in pain when I do it.I don’t have good days as my pain never goes away.just feel this whole system is flawed.plus I only received the letter today(26th September)and the letter is dated 15th September so there goes 11 days of the 30 days of getting a mandatory reconsideration sent off!so just after advice really as I will be ringing the DWP in the morning and asking for the assesors report to be sent to me and explain that it may take longer than 30 days for me to put in a MR

Sorry to hear you have not been successful, as BIS has informed you in previous post contact DWP and ask for a copy of the assessors report PA3 (paper assessment).

When you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and you will now be able to argue against them.

I usually use a highlighter to highlight any inaccuracies, once you have gone through the report you then set out why you are applying for a MR and go through each descriptor one at a time why you disagree with the assessor and try and match it with any supporting documents you may have sent in.

Understand that the assessor is offering an opinion when they say 'in my opinion' you can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said., remember they are just an opinion which is not based on fact.

Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

Lastly, make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide; benefitsandwork.co.uk/guides-for-claimants/pip

Totally get how you feel as this was me last week. I had a whole day being really upset and tearful and then the emotions went down and I concentrated on showing them what they had got wrong. My form contained mistakes like you're not on anxiety medication when I am on the highest dose. I think they try to deter you, fight back, you can do it. I know it's a shock and upsetting to read the assessment form but you can show them what they have misunderstood and go from there xx.

Be aware that when you want to challenge your mobility, it won't be enough for you to say that you can't walk more than 20 metres - because, by your own words, you can - because you can walk around a supermarket. Arguing that you are in pain will not be enough to get them to change their minds. You have to talk about the impact of the pain. You may already have done this, but you will undoubtedly have to do it again. Because of the pain, you will be walking slower than someone who doesn't have the same condition. The pain causes you to be unsteady and therefore in danger of falling or tripping. If you have examples, you should say so. Do you have to stop and lean on the trolley? Does the amount of pain you are in make you feel nauseous? Are you in danger of bumping into other shoppers with your trolley or yourself? Do you need any help when you shop (even if you don't currently have it). Do you get shortness of breath with the pain? Does the pain increase as you go around? When you finish shopping, how do you feel? Are you so exhausted that you have to sit in a car or taxi and wait for a while? Would you be able to repeat the exercise? (I know the answer to that - of course, you couldn't). I know it is distressing - but one of the biggest problems is that they cannot measure a person's pain level - so you can tell them there in pain, but it means very little - that's why you need to tell them about the impact. Forgive me if you said all these kinds of things, but you won't find it easy to counteract if you have told them you shop in a supermarket- it is one of their favourite things for refusing mobility awards.

They have also argued that you can stand at work and therefore you can make a meal. I don't know what you do for work - but clearly, there are safety issues at home. If you don't currently cook - do you have someone to cook? If you don't, you should probably argue that you don't get sufficient nutrition because the pain prevents you from cooking. If you have someone, what do you do if they are not there? They know you work, so you will have to say it's different, or you have similar problems at work.

I hope when you get the report you will have more clarity on how you can counter what they have said.

So sorry to hear the outcome of your PIP application, sadly it's not unusual for claimants to have to argue their case in this way. The overriding thing I always try to bear in mind is that the assessor reading your PIP application has no idea how your ill-health, disabilities, medical conditions etc etc impact your daily life. It's up to you to basically paint a picture of what it's like for you, or you could think of it as 'Disability For Dummies' I know it's not easy to have to think this way, but for the most part, it's what the majority of PIP applicants are forced to do to be successful in their application. Please don't let the DWP machine grind you down, the B&W family are here to help especially the very experienced MOD's. Good Luck.

Hi chri5hill,

I'm sorry to hear that your PIP assessment has come back negative.

I can't really add much to the advice that you yave already been given on the Forum.

However, the advice from SUE CC came to my attention ie 'paint a picture of what it's like for you'.

I think this is sound advice and much more important, in my opinion, than many people think.

I always think that it's rather like the old fashioned way of applying for a job. The cover letter was the most important bit until someone invented the dreaded CV.

I always make a point of putting my all into writing how it makes me feel, affects me etc - and I believe it has worked for me in the past.

Be honest and tell them from heart.

Don't be afraid of making spelling mistakes or your writing being untidy. It just shows your personality. Just put lines through mistakes, write above what it should read and, well, plough on.

I get quite unintentionally emotional writing in this way but I always feel relieved that I am putting my point(s) across.
