Good afternoon.

I'm needing some information as I'm confused on my claim for LCWRA.

I have been since since 2019. I was giving sick notes in then I had to leave work due to my son having special needs, with me not having a wage I needed to claim carers allowance (even though i still had my illnesses with no disability allowance ) and my son gets DLA.

Since I claimed Carers I wasn't asked to submit any more fit notes (although I was still ill)
A time came in 2022 and I was advised by a friend to claim PIP.

At this point I had consecutive fit notes from 7th December. I was told about LCWRA which I didnt know about I could claim. UC didn't send or tell me about UC 50 form so I had to request one. I think I did the form in Feb but unsure but the lady at uc that I spoke to today has told me that she can't tell me when they received the UC 50 but it was referred over on the 29th March 22.

I had my assessment on the 5th September 22. It took them 3 days to come to a decision so I had my first payment in September too.

They are telling me I'm only due £370 back dated money as they are only starting payments from June! I haven't had any payments relating to my LCWRA till September which the element is £354.28.

I'm confused about it all because my thinking was

I should have got a UC50 sent after the 3 months (which I didnt)

I thought they would have awarded it from my December fit notes, and I stand to my first 3 months then after that give my first payment?

It's totally confusing.

Hi Roch82

You should have been sent a UC50 form within 6 weeks of handing in a 'fit note'. The 13 weeks you mention is known as the assessment phase. If your WCA is successful and you ae awarded LCWRA then it should be put in payment from the 14th week of your assessment phase.

Your problem may be that there was a break in your 'fit note', you may want to ask your Dr if they would give you a 'fit note' from when your last one ran out. When applying for WCA you should always keep up to date with your 'fit note' until you are told by your work coach they are no longer required.
