Is it correct you don't lose anything by doing a Mandatory Reconsideration? was created by mumsgirl
Im very disappointed with my PIP review award (standard care has been continued for another 2 years) as I believe my care needs have worsened and I now have mobility issues too. It was a paper based assessment, I wasnt given a face to face or phone assessment so wasnt given the opportunity to be seen and explain further. I would like to do a MD initially, as I believe I wont lose anything, is this correct? Then maybe appeal, but we'll see lol. Can you please tell me how to do a MD? What reports do I need to get from them, the one they sent me is PIP7003, is there any others they would have produced? How long do you get to appeal? And what evidence do you need to provide? thank you

Hi mumsgirl
You have one month from the date on the decision letter in which to apply for a Mandatory Reconsideration. Contact the benefits office that gave you the decision. You can contact them:
by phone
by letter
by filling in and returning a form called CRMR1; assets.publishing.service.gov.uk/governm...sion-made-by-dwp.PDF
The contact details are on your decision letter.
As you had a paper assessment then you need to contact DWP and ask for a copy of the assessors report called a PA3, when you get a copy of the report, go through it with a highlighter marking any errors.
No it is not correct that you will not loose anything. You can loose what you have already been awarded when you ask for a MR, it is quite rare but it does sometimes happen.
Lastly, make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors. Check out our guide, benefitsandwork.co.uk/guides-for-claimants/pip

Hi mumsgirl,
Gary is correct, they can decide at MR not to award anything.
This happened to me at MR stage they took away my points and awarded me 0.
I went to appeal and the judge awarded me what I felt I should have had in the first place. However this doesnt mean that by going to appeal you will win.
You have 3 chances, the judge will either
(1) keep the award as it is. (2) increase the award. (3) take the award away.
Good luck with what you decide to do

Thank you. I really believe I am entitled to more or for longer especially as I didn't get an assessment (just paper based) but im really scared because I can't afford to lose anything as I literally wouldn't be able to afford to pay these extortionate energy prices and food etc. I think I would die, honestly, or be homeless (in which case i'd rather be dead than sleep on the wet frozen streets). Im so glad you got what you thought you should have in the end, although it must have been very stressful at the time

Hi mumsgirl
You do not have to go for a MR, before you make up your mind, contact DWP and ask for a copy of the assessors report (PA4)
Once you have a copy, you will then be able to see how the decision maker has come to their decision.
You can then decide whether to or not go for a MR. It is your decision and no one else.

I have asked for a copy of it but when I asked when I will receive it I was told 'a few weeks', but it says on the award letter I have 30days from the date of the letter (which was last week even though i only received it on Monday!) so it might not even arrive on time so I have no idea what i'm actually challenging if I decide to go ahead. Im just upset and have no idea what to do for the best because i geniunely feel my care needs have got worse (I need more help and have aids), plus I have new conditions (both care and mobility), I provided evidence. ANd with this I got no F2F and awarded 2 years standard care. Yet for my previous PIP i got 4 years standard care with lesser conditions/care needs after a F2F. I basically got the same points for the same things as last time expect for a shorter period (and they said my conditions might improve???). I suppose I should be grateful for what i got especially as I didnt have the ordeal or going for an assessment and tbh this MR stuff seems to be worse than having to fill in another PIp review form in a years time. It's so stressful and worrying.
