Looking for some advice which would be much appreciated , I am a carer for my wife who suffers from bipolar disorder and other mental heath problem’s, she has been on medication for a number of years now and although the meds do help she still has many daily challenges which make our day to day life a bit of a rollercoaster, I have managed to hold our routine’s together just but it is difficult. I applied for PIP for her about five years ago to which she was successful and was awarded enhanced daily living allowance which at the the time was a huge relief as I was very limited for work as most of my time was taking up caring for my wife. She unfortunately wasn’t awarded any mobility help even though she cannot leave the house without my self and my guidance, fast forward two years and her review I again tried for mobility help and was awarded standard mobility which helped immensely at the time as getting about was extremely challenging for her, I was going to appeal at the time but I was to mentally and physically drained and I didn’t have the will to fight and with the pandemic just starting at the time I just gave up. She was awarded 10 points even thought my wife cannot follow a familiar journey without another person which I started in the review application. My wife’s next review is in 2024 and after carefully considering our options I have decide to fight her claim again and would be extremely grateful if someone would be able to point me in the right direction about how I would go about challenging the decision before her next review in 2024.

In order to challenge an award, you must put in for a mandatory reconsideration within one month of the decision letter. If you miss that deadline, then you have up to a year to put in a late mandatory reconsideration. So it's not possible for you to challenge the award now.

You have two options. 1) Wait until your wife's next review, read our guides and try and make a stronger case for increased mobility. You can also say that you would have challenged the previous decision but were unable to do so.

2) You can put in for a change of circumstances - say (if it's true) that her mobility has decreased due to her mental health and ask them to look at it again. Clearly, you will have to try and make a stronger case. If you haven't already, you need to get hold of the PA4 (assessor's report) from the previous award so you understand why she wasn't awarded any higher.

Thank you for your reply and helpful information, would a change in circumstances for her mobility component trigger a whole new claim again .The original claim was very stressful for my wife and myself and the thought of going through the whole process again fills me with dread, I forgot to mention we live in Scotland and as far as I believe the Scottish government is in the process of taking over PIP so it’s confusing as where to start regarding who I contact. Thanks again

Yes a change of circumstances would trigger a new claim, if successful then it would be backdated to the date you requested a change of circumstances.

PIP is changing in Scotland, you will need to contact; www.citizensadvice.org.uk/scotland/benefits/ or www.mygov.scot/benefits-support

Reporting a change in condition to PIP should trigger a case transfer to Adult Disability Payment. Scottish Social Security will then do the review and pay any backdating. I have notified changes of circumstances for clients since 29/8 but have not had anyone come back to me to let me know if the transfer has been successful. Hopefully the DWP will follow the transfer process and you will have a less invasive assessment process with SSS.
