Pip tribunal Dwp missed deadline? was created by Chrissy
Hi,
We have appealed my husbands decision for pip and taken it to tribunal stage(he was turned down again at mc stage). The Dwp have missed their deadline in which they were meant to respond to the tribunal in the first instance (13th October). Does anyone know how we should proceed now and if this will go in his favour? No update has been made since on the online process

HI Chrissy

You don't have to do anything. The DWP quite often miss deadlines for submitting their response. The Tribunals Service will write to them and give them a new deadline. If they don't submit it again - the judge will decide whether the tribunal can go ahead without their evidence or whether it will need to be delayed.

Hi,
If I may......

My MR, as expected, didn`t alter the award (Enhanced Daily Living / 4 points Mobility) so I took it to tribunal.
DWP missed the deadline (expected) so I emailed HMCTS asking what happens next. This is their reply:
"Currently the Tribunal are reviewing appeals 21 days after a response is due. If there is no response when the appeal is reviewed then the appeal will be sent to the Judiciary for a decision to be made on how the appeal should proceed."
In my case it was irrelevant because DWP reviewed my application again and changed not only mobility to enhanced, but the length of the award to ongoing (from a 3 year period).
