You need to speak to the manager of the trust, only they can tell the terms of the trust's operation.

Dear Gordon, thank you for your response.
I have now spoken to the trustees. Their understanding is that although the terms of the trust would allow them to pay some or all of my household fuel costs this would result in a corresponding reduction in my ESA payments by the DWP, and so there is no point in the trust making a payment for fuel costs. They say that household fuel costs are regarded as "everyday living expenses" as defined in ESA Regs 107 (3)(c) . Do you think this is right, or do you think that as my fuel costs are higher than those of an average person because of my medical condition the additional cost might not be regarded as "everyday living expenses" ? If so, do you know how the additional amount could be calculated ?
Many thanks

Hi Edward
Thank you for your interesting question, I cannot answer as I do not know anything about trusts, your question is also outside the remit of the forum.
You do need to seak to someone who knows about trust laws, you could try your local Welfare Rights Organisation; you can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk
