Apologise if this is out of scope as it not about assessments, its about claim criteria.
I have been on IBESA in SG for a number of years and was moved recently to CBESA Support group incorrectly, due to having house sale equity for 4½ months and genuinely looking for another house, which should be disregarded for at least 6 months and longer if a valid reason, and this has already been challenged and I am awaiting a response, so this is not the question, the question is if monies from inheritance or pension lump sums are received (not pension income) over the £16000 capital limit, would someone on IBESA in SG still qualify for CBESA SG on an unlimited basis as this is what is suggested on the gov site, that the 12 month CBESA claim rule does not apply if in the SG and that the claim continues indefinitely, outside of having to claim UC, calling it New Style ESA, seemingly due to being in SG and having had NI contribution credits made whilst on IBESA for at least 2 years. The reason is I am looking at the possibility of accessing a pension lump sum to help with house purchase and the DWP would not give any kind of confirmation as to whether this would or would not affect IBESA even though this request was made by MP to his own DWP contacts. It may be useful for people to know what the situation is if they are on IBESA in SG and receive an inheritance or pension lump sum, which would vastly reduce or nullify IBESA, in that CBESA in SG may be able to be claimed, on a non time limited basis, rather than not having a claim, albeit the CBESA would be less than the IBESA. Time spent in the Support Group or LCWRA Group do not count towards the towards the 365 day limit for ESA(CB) or NS ESA, so as long as you remain in one of those groups then your ESA will be continued to be paid indefinitely.
