Hi,

I have Mental health issues and ASD which are well documented(evidenced), PIP is aware of how this effects my daily living and I am currently in claim for these.
In 2019 I saw a Neurologist who after an MRI diagnosed Lumbar Spondylosis with crowding of the nerves in and multi foraminal narrowing etc... this was affecting my ability to walk any great distance at this time. (I still have the diagnosis letters from this time) When my Mum died in 2019 the local council gave me a one-bedroom Bungalow after receiving letters from my GP and Neurologist at the time with regard to the effects of Lumbar Spondylosis on me day to day, climbing stairs, and restricted walking etc.. Over the last 2/3 years things have got progressively worse.
The Bungalow has a bathroom with a walk-in shower with a fitted shower seat and grab rails I also have rails near the backdoor all which help me day to day as thing are now. Things regarding my Lumbar Spondylosis have got considerably worse since 2019 and although I hate to blame the Pandemic it has been very hard to get treatment except anti inflammataries from my GP.
The Bungalow was adapted for the previous Tenant.
I have an Occupational Therapist from the adult social services due to visit me with a regard to recommending aids for my condition including increasing the size of the shower area (the last tenant was a little old lady) they are recommending perching stalls for the bathroom and kitchen sinks, a raised toilet seat and any other recommendations when they visit me. Along with my Exertion Angina it makes things difficult for me to walk any distance without resting and then continuing.
I had to change GP's during the Pandemic and they are not very informed as to my Lumbar Spondylosis as I have seen them much due to getting face to face appts etc. The GP took me off my anti inflammataries due to my heart disease and put me on Co-Codamol 30/500 which are useless.
After reading the above, do you think I could have a good case for asking for a PIP review(although ultimately it has to be my decision).
Sorry about the long-winded post or it reads mixed up, but due to the nature of my Mental health conditions I am a worrier and like to get my point across the best I can. Thanks for your patience.

Hi Rob1,
You can certainly ask for a review, but there is no point unless you will get an increased award. So, even though you might now need 2 or 3 gadgets to help with each activity you will still get the same points for using just one aid/appliance. Likewise under Mobility, the initial points score is from 50 to 200m so say you could walk 180m before and now is 60m that considerably less ability but still fits within the 50-200m bracket.
Of course if you now need gadgets etc as a new thing, (and of course you being moved to a disability friendly bungalow is good evidence) and your walking distance now falls within a different points level then this suggests you could get a higher award. However you would need to be able to score enough additional points either give a standard award where you didn't get one before or additional points sufficient to gain enhanced level. Otherwise there is no point to asking for a review, as you will have all the hassle of applying, together with the possibility of an assessment , and as some times happens, the worry of losing some or all of what you already have but still can't get a better award!
Things like bath rails and raised toilet seats can comprise aids/appliances. Whilst having these installed will no doubt help you maintain some independence just think whether these are sufficient particularly to keep you safe. So eg if you still fall or stumble out if the bath or lifting off the toilet despite using a rail etc, then you may need to consider whether you actually need physical assistance from another person. Whilst I appreciate if you live alone you may not get this help, PIP points should be awarded in the basis of need.
Think about the aid or appliance/gadget you use. How does it help you to achieve the various PIP tasks? If you remain "unsafe" ie there is a risk of substantial harm to you or another despite the gadgets etc, you could argue physical help or even can not do at all.
Likewise you need to be able to do PIP activities in a reasonable time and repeatedly as well as to an acceptable standard.All 4 criteria need to be met. Significant amounts of pain may comprise non acceptable standard.
This may also be relevant to whether or not you could get sufficient extra points for an effective review. Remember that you can only score once under each descriptor. This should be the highest value when everything is equal. If you already have say 2 points under a descriptor and could now score 4, your net difference is only 2 points. ( The original 2 is now replaced by 4.)

Hi,

I forgot to add that I only have an award for Daily Living for Mental Health-Standard Rate from early 2019 which was before I saw the Neurologist etc for Lumber Spondylosis (for which I am grateful) but at present have no award for Mobility, so any possible award for mobility would be an increased award.
