ESA to Universal Credit if I change address?

Hello. Could you advise me if I move (in the same local area) would my ESA support group claim automatically stop and would I have to change to claiming Universal Credit with the waiting period that involves? I believe for Housing benefit if I stay in the same local area my Housing Bene would not change to Universal credit, but would a change of address for ESA not mean that I would be forced to claim Universal Credit instead?

Hi Jennifer

You have not stated once what type of ESAyou are receiving, although you have stated moving within the same local authority.

If you are in receipt of housing benefit and move within the same local authority then you can stay on legacy benefits, you do not have to apply for UC.

If you do not claim housing benefit and move to another local authority , you do not have to apply for UC.

At this moment in time, if you have to claim housing benefit and you move local authorities then you will have to claim UC to claim the housing element not housing benefit.

Thank you Gary - I receive income related ESA and am currently in the support group for my ME/CFS and incontinence. Whilst I would obviously find the physical side of packing and moving extremely hard I have been a victim of extreme ASB at my current address with my neigbour threatening to kill me and petrol bomb my flat yet the housing association has done nothing. I am also looking to downsize as I currently over occupy by 1 bedroom & can no longer afford to pay the 'bedroom tax'. I was just worried that a move would necessitate a change from my current ESA and housing bene to Universal Credit, in which case it would not make financial sense with the 5 week waiting period.

Hi Jennifer

Sorry to hear about your plight, does your housing association not have an ASB officer, have they not provided you with diaries to record any incidents.

If you are under occupied you can apply to your local authority for a discretionary housing payment for your housing benefit shortfall so that you do not get into rent arrears.

Moving within the same local authority will not at this moment in time mean having to apply for UC, although some areas across the uk have started the migration process, so just check before doing anything that your area is not one of the areas that has started the migration process. I believe managed migration will start in earnest next year.
