Help urgent UC and own my flat. was created by Rae323
Hi, I’ve received a message from UC today to tell my that they are phoning me on Friday and require all information about divorce proceeds, bank statements from Oct 2021, any savings and earnings.
Obviously they can see what they like as I’ve nothing to hide.
I’ve believed my ex husband has phoned them out of spite.
Sold the house in Oct 2021, I then had to sofa surf until the proceeds came through in Jan 2022, divorce was finalised and he finally agreed to let me have my share, which amounted to £135,000.00.
I knew this was to buy me a small 1bed flat which happened end of March.
This flat is to last me for the rest of my life.
I’m 48, work 13hrs a week due to mental health mainly due to domestic abuse and other issues.
I have PIP and UC.
I have no savings, I’m always overdrawn and have a DMP for credit cards.
Will the divorce proceeds been seen as savings, should I have told them?
Is my flat seen as equity, assets etc…
Can anyone help or advise please?

There are lots of potential problems with the scenario that you describe in your post, not keeping the DWP up-to-date with your situation is certainly one.
I am going to recommend that you get advice from a local advice agency, ideally, you want to speak to a Welfare Rights Officer as your situation is complicated.
Things you should be thinking about for the meeting;
1. When did you claim UC? Were you with your husband at the time making it a joint claim, or did you claim after you separated so it was a single person claim.
2. Do you have documentation explaining why you had no access to the money until Jan 2022?
3. Can you explain why you did not contact the DWP, all of the documentation you might have seen in regard to your UC claim would have said that receiving this amount of money had to be reported to them.

Hi, I’d been claiming UC for a while on my own.
Couldn’t work properly because of the domestic abuse.
I have a solicitor’s letters stating that my ex won’t allow me access to the funds until he sees fit of divorce is completed- mid Jan.
Not an excuse but my 15yr old son was diagnosed with cancer at the same time and it completely went out of my head, coupled with having to find somewhere to live as I was sofa surfing.

Don't fret. You might find you enjoyed a 6 month disregard from the receipt of for the settlement and purchase of a new property.
(The disregard meaning the money didn't count for that period as 'savings'. More so as you were buying somewhere else.)
