Hi
Interested on any feedback on my experience of assisting clients currently with PIP Mandatory Reconsiderations ( MR)
When clients have requested MR by telephone and requesting copy of evidence used including Assessors Report (PA4) despite asking that DWP not to make a decision until additional evidence is submitted including letter from myself at CAB they have told client that they have 4 weeks to supply additional evidence. However often takes over a week for us and client to receive PA4.
In one instance after 2 weeks and no PA4 had to phone up at client appointment and agent said that original request to lodge MR and send out PA4 had been dealt with a call handler in Belfast who did not fully understand original request and had not lodged MR and send PA4.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Bob
As soon as a claimant has had their assessment - they can put in a request for the PA4. They are supposed to be with the DWP within 48 hours - (Of course, that isn't always the case) and it often takes 7 days (or more) to arrive. When I'm helping people, I always advise them to put in that call at the earliest opportunity. When the letter arrives I write a letter to the decision maker objecting to the PA4 and asking them to review the information. (Sometimes, this has worked because the decision is different from the report). I also say in the letter that we are reserving the right to put in for an MR when the Decision Letter is received. As there are four weeks from the Decision Letter to put in for the MR - I generally find I can lengthen the time to do it. You can't actually stop the time when the decision is made. They didn't use to give extra time to put in for an MR, but they have done to some claimants more recently.

Hello Bob
When I requested my PA4 and subsequently submitted my 'Pre-Decision' letter to the 'Decision Maker' in the pre-decision window, approximately 8 weeks, I printed in bold that it was NOT an MR request. Perhaps you need to state the same when contacting the DWP by phone. I still had to go through the whole MR process which then took a further 4 months of reconsidering and then my original rates were reinstated.
