I've Missed my MR Deadline - What next? was created by MS3
Hello,
I've recently missed the deadline for the MR it was dated on the 10th October but I believe I received it 2 days later (12-14th October). Following the guidelines and recommendations from the BAW team, I requested the assessment report which was received by the 19th October. I needed this to challenge the MR otherwise, I would not know the reasons why they have rejected it.
I am of the view that my deadline would be 20th November (the date on the rejection letter)is this correct? In which case, I have missed it by 1 week so far.
If so, I understand that I have a 12 month window to resubmit it. The reason for my delay was I've had an overwhelming amount of distress with this whole process, which has further impacted my depression and anxiety and as a result I have increased my dosage with my doctors from 15mg to 200MG starting next week. I really find this all overwhelming as you can imagine with my current life situations happening at the same time.
I also want to know whether calling them out of the MR deadline can warrant an extension from them or should I submit the MR with my reasons that my health has deteriorated further, I have medical evidence of this also..
Finally, if I can submit the reasons for the extension, the MR form has the following question:
Are you asking us to look at your
decision again within one month of
the date on your decision letter?
- Yes or No
Do I tick yes or no for this as it will not be within the 1 month window?

Because you have missed the one-month deadline - you need to ring them and get permission to put in a late submission - saying that you have been ill. and your condition has deteriorated (They don't have to accept your reason - but they generally do, and you have the evidence of the impact.) Once the phone call is over, ensure you follow up with a letter saying you made the call and have been granted the opportunity to submit late. (You don't want the DWP to say they have no knowledge of the call - which has occasionally been known to happen). You will then be given a date by which you need to submit your MR.
The answer to the question will be no and I would write in brackets (late extension as agreed)
