New claim when still in appeal stage? was created by Jobadgery
Hello there people.
I’m currently waiting for a hearing, i started the claim in April . My Co diction has sadly deteriorated much more and has taken a different turn. I would have put much more info otherwise. ( I’m now having tests for brain tumours and get excessive headaches, sight loss etc) this was never in my original claim only other main symptoms ( all related to this !- but never picked up)
So … do I start a new claim ? Or just wait and explain everything at the tribunal ? I just don’t want them to say “ it’s much worse than you said and has worsened you should have started a new claim” etc ! Thank you

Hi Jobadgery

Welcome to the forum.

You might want to have a look at the following FAQ which explains where everything is; www.benefitsandwork.co.uk/guides-for-claimants/faq/forum

We cannot answer your question as we do not know how you were when you made the initial application, remember a tribunal will be look at how you were when you had your assessment, they will not be looking at how you are now.

Claimants will say they are much worse, which goes against them. The tribunal will usually advise the claimants to make a new claim, even if your condition has deteriorated.

Quite often claimants are waiting for a diagnoses which is ok to say at a tribunal, did you get headaches before the assessment? if you did then your condition is ongoing.
