Mobility Appeal was created by craig41
A relative of mine who currently receives the standard mobility element is now being re-assessed. She believes she should be entitled to the upper limit mobility element.If after the assessment she only qualified for the standard premium,would she still receive the standard payments during the wait to appeal?

You say your relative is being 'reassessed', but I'm not sure whether you mean she is going through a review process, or she has put in for a change of circumstances, or she is already going through the mandatory reconsideration process.
There are three possible options.
1. Her award is downgraded, and she receives nothing for mobility. Her payments for mobility would be stopped immediately.
2. Her award remains unchanged. She will continue to be paid the standard rate for mobility, and she can put in for a mandatory reconsideration.
3. Her award is upgraded to enhanced mobility.

Apologies I was not clear in my post.
My relative is being reviewed. I basically was asking if she either went to MR/Appeal, would her mobility payments(assuming her award stays the same)be stopped until a final decision was made or would she continue receiving her mobility standard award during this time.
It may mean that if monies were stopped she may decide to accept the decision as she would not be able to pay for her car( not a mobility car)

If your relative was awarded zero points then their claim would stop.
If they were awarded standard rate and they thought they should have got enhanced, if they applied for a MR or appeal after it was in patment then they would continue to receive standard rate whilst waiting for MR/Appeal.
