Hi
I have just been awarded both components of PIP at enhanced rates
I am really worried and stressed as my mobility fluctuates each day
I either can’t walk 20mts 60% of the time or I can walk 100 Mts - 200mts on a really good day 10-20% of the time
I keep reading about fraud and I am scared to death of being prosecuted
I feel like giving it back I even though I need it
How long should you wait to inform of changes in circumstances if I think my mobility has improved as it changes every day many thanks

Hi Jeff

I am so glad to hear you got the award. I really don’t think you should have any concerns about your right to it.
The award is based around your worst days not your better days and we are all aware that there are never any good days for our conditions just better days.
Obviously if there is a longer term improvement then you should take advice from your GP or consultant as to whether it will last. Then you can take a considered decision.
In the meantime make use of what you are entitled to without fear or guilt.

I would like to echo what Peter has advised. I would not worry about what you are claiming. Under Regulation 7 you are to be assessed on not being able to do an activity "Reliably" for more that 50% of the time. So what you said shows that you are not breaking the law or committing fraud so you have nothing to worry about.

Hi Jeff,
Just to clarify things a bit further. Waxwing mentioned Reg.7. This requires (all) descriptors to be done to an acceptable standard, ie without significant pain, and done in a reasonably normal manner, in a reasonable time, (taking no longer than twice that of non disabled person) Repeatedly across the whole day as many times as reasonably required and safely, ie in a manner unlikely to cause you substantial harm eg by falling over or heart attack through exertion.
All 4 of these criteria have to apply for the majority of days. The purpose if Reg 7 is to accommodate variable conditions such as yours.

Please don't worry about your award. As long as you were truthful on the form if DWP conclude that you score sufficient for enhanced rate then clearly they accept significant disability. Double enhanced awards are not given out lightly Your!
Your award for mobility will no doubt take into account things such as pain, the manner of your walking, speed, falls etc exhaustion and the holistic effect of walking on all parts of your body, not just the obvious legs or back. Any walking done with significant levels of pain will fail to reach an acceptable standard This can mean that although you can physically walk several 100 meters the distance won't be counted as it fails Reg 7.
If you fail to reach all the other required elements under Reg 7 you legally can't 'repeat'.
Although you don't say much about the nature of your disability, the award of 12 or more points given variation of walking ability you describe doesn't sound implausible. You appear to be unable to 'repeat'.
It is easy to overthink these things! You have done very well to get your award!
