PIP Review where assessor used an old PA3

My new Award has come through, only as standard daily living where I believe it should be the higher rate. My current evidence is sufficient I believe to have justified the higher Award. The reason I am particularly concerned that no new PA3 has been done this time is because the last PA3 done a few years ago was not done properly because the assessor I strongly believe missed one of my key evidence letters back then. The key evidence letter missed back then contained the majority of my evidence, thus ending up with a poor PA3 . Back then, I was not well enough to fight this so accepted the low Award. The points were back then short on the engaging face to face/mixing with others. Also the case law that came about regarding the meaning of social support also likely would have brought my points up, not just the evidence letter that was overlooked. Now this old PA3 has been used for my new Award. So because my Award has been partially based on the 'incorrect' PA3 from a few years back, this hasn't done me any favours with this time's Award. I am planning on doing a MR, and could easily point out where I believe my new evidence has not been applied and scoring is wrong, but should I also write about the fact that they have used the old 'incorrect' PA3?

Hi Perdita

If you believe that they used the wrong supporting documents then tell them, when you write in for a MR, re-send the documents you believe is missing.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

Lastly, make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors.

There are no missing documents this time. The issue is they did not create a new PA3 this time, so they are using an old PA3 from a few years ago. They have listed this old PA3 as evidence used this time, but it was done wrong back those years ago.,that old PA3 they have used this time, was created back then without using the letter containing the majority of the evidence.
