Hi, could I ask for advice about ESA 1 form? I’ve been awarded PIP whilst still receiving National insurance Contributiond for Contributions based ESA but I sent in a changes to conditions esa50 form. Ive had the assessment after waiting 6 months ! They’ve now sent me an ESA 1. Confused re can I get statutory sick pay? I get no ESA at the moment and I don’t need to submit dick notes as they stopped esa benefit after a year ? Can anyone help me. Thanks in advance p

My best guess is that your latest assessment has moved you to the Support Group and as a result the DWP are trying to reinstate your ESA claim.

However, it is likely that your computer record was deleted when payments stopped, the ESA1 form is required in order to re-build it.

Thanks Gordon. My original ESA claim was Sept 2019. I got it for a year ( contributions based ) until Oct 2020 after a successful tribunal, then they continued paying my NIC, I resubmitted changes in Aug 2022. What date should I put on the new form and they ask what type of ESA I’m applying for ? Shall I tick income based ?. Thanks in advance.

I would put a start date for when you notified the DWP of a change in your conditions, as to the type, I would put Contributory, if any Income Related is payable then it should be paid automatically.
